Terms of Service
The agreement between you, as an individual user, and ReCaptured. Your organization's subscription is covered separately by its order form, pilot agreement or signed agreement with us.
Version 1.1 takes effect on November 18, 2026. Until then, Version 1.0 applies. What changed: we added that our AI providers may not train on your content (§6); health information is not accepted (§8); we defined ‘paid term’ for monthly plans (§12); we clarified where previous versions live (§17).
These Terms of Service ("Terms") are an agreement between you and RECAPTURED, LLC, a Delaware limited liability company ("ReCaptured," "we," "us"). They cover your use of the ReCaptured platform: the web app at app.recaptured.io, our mobile and desktop apps, our APIs and our MCP server (together, the "Service").
By checking the box to agree to these Terms in the app, you accept them. If you do not agree, do not use the Service. Until you have accepted them in the app, your organization's order form or pilot agreement governs your use of the Service.

1. Who can use the Service
- The Service is for business use. You can use it only if you have been invited by an organization that has an agreement with us (a "Customer").
- You must be at least 18 years old and able to form a binding contract.
- You may not use the Service if the law prohibits you from receiving it, including under U.S. sanctions or export laws.
2. Your organization's agreement
- The Customer Agreement. Each Customer has its own agreement with us: an order form, a pilot agreement, a signed Master Services Agreement or, once we publish them, our online Customer Terms, together with a Data Processing Addendum where one has been signed (the "Customer Agreement"). The Customer Agreement covers the Customer's subscription, fees, data protection and service commitments.
- Order of precedence. These Terms cover your personal use as an individual user. If these Terms and the Customer Agreement conflict on a matter between ReCaptured and the Customer, the Customer Agreement controls.
- Accepting for your organization. If you accept a Customer Agreement on behalf of an organization, you confirm that you have authority to bind it.
3. Your account
- Keep it secure. Keep your sign-in details and authentication devices secure, and do not share your account. Multi-factor authentication is required for every account.
- Your responsibility. You are responsible for activity under your account unless it was caused by our failure to secure the Service.
- Unauthorized use. Tell your organization's administrator, and security@recaptured.io, immediately if you suspect unauthorized use.
- Accurate details. Keep your name and email address accurate.
4. Your organization controls your account
Your account exists within the Customer's workspace, and the Customer's administrators control it. They can:
- invite, suspend and remove users;
- change roles and seat types;
- reset multi-factor authentication and end sessions;
- see account details, activity and sign-in sessions;
- manage, export or delete content in the workspace, including messages.
If you leave the organization, or the Customer's subscription ends, your access to that workspace ends. Content you created in the workspace belongs to the Customer and stays with it. If you belong to more than one organization, each one controls your access to its own workspace.
5. Content
- Customer Data. "Customer Data" means the content that you, the Customer and its users put into or connect to the Service. As between ReCaptured and the Customer, the Customer owns Customer Data.
- Permission to process it. You give us permission to host, copy, process, transmit and display Customer Data only as needed to provide, secure and support the Service for the Customer, and as described in the Customer Agreement and our Privacy Notice.
- Your rights in what you upload. You confirm that you have the rights and any permissions or notices needed to put your content into the Service.
- Platform materials. We own the Service, including the software, templates, packs and documentation. We give you a limited, non-exclusive, non-transferable right to use them through the Service while you have access. Some components are third-party or open-source software under their own licenses.
- Feedback. If you send us suggestions, we may use them without any obligation to you.
6. AI features
- What AI features do. Some features use artificial intelligence: the assistant, summaries, transcription, search, knowledge extraction and data enrichment. AI output can be wrong, incomplete or out of date. Review it before you rely on it, especially for legal, financial, safety, employment or health matters. AI output is not professional advice.
- How content is handled. Content sent to AI providers is screened first, and we do not use Customer Data to train AI models that serve other customers. We do not permit our AI providers to train on it. Details are in the Privacy Notice.
- Labels. AI-generated content is labelled in the product. Do not remove those labels when you present AI output as your own work to people who would reasonably expect to know.
- Actions require your confirmation. If you let the assistant or a connected AI app take actions (for example, create or update records), you are responsible for what you approve. Write actions require explicit permission and confirmation.
- Customers' own AI apps. A Customer can connect its own AI app through our MCP server. Data that leaves the Service that way is handled by that app under the Customer's own arrangements with its provider, not ours.
7. Recording, monitoring and signatures
- Meetings. Before a meeting is recorded, the Service asks every participant for consent. Do not record, or attempt to record, anyone who has not agreed.
- Field audio and location. If your organization uses field audio or location features, it is responsible for any notice or consent the law requires from its people. The Service helps record that notice or consent but does not replace it.
- Electronic signatures. Signing a document electronically through the Service requires agreeing to a separate electronic records and signatures disclosure. Whether a signature is legally effective for a particular document depends on the law that applies to it. ReCaptured is not a party to documents signed through the Service.
8. Restricted data
- Health information. Do not put protected health information (as defined by HIPAA) into the Service. ReCaptured does not currently sign Business Associate Agreements or accept health information.
- Controlled Unclassified Information. Do not put Controlled Unclassified Information or export-controlled technical data into the Service unless your organization has been designated for it in writing by ReCaptured.
- Payment card data. Do not enter payment card numbers into records, messages or files. Payments are handled through Stripe's own forms.
9. Acceptable use
You must follow our Acceptable Use Policy. It is part of these Terms.
10. Third-party services
- Connected tools. The Service can connect to third-party tools such as Google Workspace, Microsoft 365 and Slack. Your use of those tools is governed by their own terms, and we are not responsible for them.
- What happens when you connect one. You authorize the Service to access the connected tool's data within the permissions you grant, to provide the feature you turn on. You can disconnect at any time.
11. Fees
- Who pays. The Customer pays for the Service under the Customer Agreement. You do not owe us fees personally unless you are the Customer.
- Unpaid invoices. If the Customer's account is past due, access may be limited until it is resolved. Data is not deleted because of a billing hold.
12. Changes to the Service
- The Service will change. We are continually developing it, and features may be added, changed or removed.
- Material reductions. We will not materially reduce the core functionality of a Customer's subscription during a paid term (for monthly plans, the current billing month), except as the Customer Agreement allows.
- Preview features. Features labelled beta, preview or early access are provided as they are, may change or end at any time, and may have reduced support.
13. Suspension and termination
- Who can end your access. Your organization can end your access at any time.
- When we may suspend or end your access. We may suspend or end your access if you materially breach these Terms or the Acceptable Use Policy; if your use creates a security risk or legal exposure for ReCaptured, a Customer or others; or if the law requires it.
- Notice. Where reasonable, we will give notice and a chance to fix the problem first. In an emergency we may act immediately and tell you afterwards.
- Leaving. You may stop using the Service at any time.
- What survives. Sections 5, 14, 15, 16, 18 and 19 continue after termination.
14. Disclaimers
TO THE EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE." As between you personally and ReCaptured, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. This section does not limit any commitment we make to a Customer in the Customer Agreement.
15. Limitation of liability
To the extent the law allows: (a) neither you nor ReCaptured is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business or data, arising out of these Terms or your use of the Service; and (b) ReCaptured's total liability to you personally for all claims arising out of these Terms is limited to one hundred U.S. dollars ($100).
Nothing in this section limits liability that cannot be limited by law, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence. Nothing in this section limits any commitment we make to a Customer in the Customer Agreement or a Customer's remedies under it.
16. Responsibility for misuse
If your breach of these Terms or the Acceptable Use Policy leads to a claim against ReCaptured, you will cooperate with us in good faith to resolve it. Any indemnity obligations between ReCaptured and a Customer are set out in the Customer Agreement, not in these Terms.
17. Changes to these Terms
- Material changes. If we make a material change to these Terms or the Acceptable Use Policy, we will tell you at least 30 days before it takes effect, by email and in the app, with a summary of what changed. On the effective date, you will need to accept the new version before you continue using the Service. If you do not accept, do not continue using the Service; your organization's rights are covered by the Customer Agreement.
- Shorter notice. We may make changes on shorter notice only where the law requires it or to address an urgent security risk, and we will tell you why.
- Other changes. Non-material changes, such as clarifications, corrections or updated contact details, take effect when published with a new effective date.
- Past versions. Every version stays linked from the top of this page.
- No change by continued use alone. We will not treat your continued use of the Service as acceptance of a material change.
18. Governing law and disputes
Delaware law governs these Terms, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of the Service will be brought in the state or federal courts located in Delaware, and you and we each consent to their jurisdiction. Before starting a claim, you and we agree to try to resolve the dispute by contacting each other in writing first. Nothing in this section prevents either of us from seeking an injunction to protect intellectual property or confidential information in any court with jurisdiction.
19. General
- Entire agreement. These Terms, the Acceptable Use Policy and the documents they link to are the entire agreement between you and us about your individual use of the Service.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
- Severability. If a provision is unenforceable, the rest remains in effect.
- No waiver. Not enforcing a provision is not a waiver.
- Language. If we provide a translation, the English version controls.
